#AceNewsReport – Oct.22: A man who raised a sawn-off shotgun to his victim’s head and exclaimed ‘F**k you, Phil’ before shooting him in the face during a violent home invasion has been sentenced to a maximum of 11 years’ jail.

Joshua Rae, aged 32, was one of three men who burst into Phillip Stennett’s unit in the Newcastle suburb of Hamilton in December 2017 and confronted him in a violent attack inside his home: The court heard that Mr Stennett grabbed an ornamental samurai sword and used it to slash the forearm of one of the intruders, at which point Rae produced a sawn-off shotgun, raised it to Mr Stennett’s head and said “F**k you, Phil” before pulling the trigger.
Mr Stennett, who survived the attack but bears significant injuries, was not at the sentencing hearing but his mother, Janice Stennett, sobbed loudly in court as Newcastle District Court judge Tim Gartelmann read out transcripts of taped phone conversations Rae had with associates admitting to the shooting and recounting graphic details of the attack: “As I turned I could see half his face hanging off and he was stumbling,” Judge Gartelmann read of Rae’s comments during the recorded conversations………….”I shot him in the face … went in there with a couple of mates and he got a bit cheeky.
“He died a few days later in surgery getting bits of his jaw removed,” Judge Gartelmann quoted Rae telling one of his associates after the attack: At the time Rae incorrectly thought that Mr Stennett had died during surgery.
Instead Judge Gartelmann described the moments straight after the incident, after the attackers fled and how Mr Stennett’s friends led the “disorientated” victim to the bathroom where they applied “bath towels and clothing to his face to stem the flow of blood”.
In his closing remarks, Judge Gartelmann said: Rae had very little regard for what had happened to his victim, who he noted was very lucky to be alive after the attack, and referred to a victim impact statement that identified significant injuries including facial disfigurement, psychological trauma, and speech impairment due to the complete loss of the use of his tongue: After the attack police closed in on Rae and tried to arrest him in Kempsey where Rae resisted arrest by speeding off in his car and leading police on a high-speed pursuit through residential areas that saw his car reaching speeds of up to 200kph before he was eventually captured.
In his sentencing remarks…..Judge Gartelmann noted Rae showed some insight into his crimes but retained only a limited prospect of rehabilitation before handing Rae a non-parole period of eight years and three months: He said Rae’s victim was lucky to have survived the attack and would bear lifelong scars including facial disfigurement, psychological trauma, and speech impediment from the complete loss of the use of his tongue………………..Judge Gartelmann applied a 25 per cent discount after noting Rae’s early guilty pleas to the main charge of discharging a firearm with an intention to cause grievous bodily harm, and several other offences relating to firearm possession, keeping stolen property, and evading police during the police pursuit.
A co-offender, who was injured during the attack, will be sentenced at a later date…….
With time already served Rae could be released on parole in April 2026.
