Judge Thokozile Masipa said Friday that the double-amputee athlete was not guilty of murder, as prosecutors had alleged. She ordered Pistorius to stand before she delivered the verdict.

The sentence for a culpable homicide conviction is at the judge’s discretion, and it can range from a suspended sentence and a fine to up to 15 years in prison. Sentencing was to be announced at a later date.

Pistorius was also convicted on one of three unrelated firearm charges. The judge ruled that the athlete was guilty of unlawfully firing a gun in a public place when a friend’s pistol he was handling discharged under a table in a restaurant in Johannesburg in early 2013 — weeks before Steenkamp’s killing.

Pistorius was acquitted on two other gun charges, including a count of firing a gun in public and a count of illegal possession of ammunition in the Pretoria home where he killed Steenkamp.

On Thursday the judge found there was not enough evidence to convict him of pre-meditated murder.

` African National Congress Party is set to Win the South Africa Election by a Massive Majority ‘

#AceWorldNews – PRETORIA – SOUTH AFRICA – May 09 – The ruling African National Congress (ANC) is set to win South Africa’s fifth democratic election by a significant majority, debunking speculation that the party would be severely tested this week.

At midday on Friday, after an estimated 97.96 percent of votes had been tallied, the ANC was the outright leader with 62.2 percent of the count.

The official opposition, the Democratic Alliance (DA), was sitting on 22.19 percent in second place.

Addressing the media on Friday, Pansy Tlakula, chairperson of the Independent Electoral Commission (IEC) announced that counting in the country’s fifth democratic election was nearly complete.

“We are nearly home,” Tlakula said.

In three of the country’s nine provinces, results have been finalised. Officials say the counting in the other six provinces is at an advanced stage.

The IEC is expected to announce the results on Saturday.

“With 97,96 percent of results captured, we are confident of being able to announce the official results tomorrow,” Tlakula said.

#AceWorldNews – PRETORIA – SOUTH AFRICA – April 16 – (BBC) – The girlfriend of Oscar Pistorius was shot in quick succession as she fell down, a forensics expert has told the South African athlete’s murder trial.


This differs from a police ballistics witness who said there was short break between the first and second shots.

Mr Pistorius denies intentionally killing Ms Steenkamp in early hours of Valentine’s Day last year.

He says he fired rapidly in fear through the toilet door after he mistook Ms Steenkamp for an intruder.

The prosecution says the 29-year-old model and law graduate was deliberately killed after the couple had an argument.

The double amputee Olympic and Paralympic athlete faces 25 years to life in prison if convicted of premeditated murder.

The trial has been adjourned until Thursday, which will be the last day before a break; proceedings will resume on Monday 5 May.

Oscar Pistorius Trial: ` Murder Trial Jury gets to see the Valentines Card which he gave to his Girlfriend '

#AceWorldNews – PRETORIA – SOUTH AFRICA – April 15 – (BBC) – The Oscar Pistorius murder trial has seen a Valentine’s card which his girlfriend Reeva Steenkamp had intended to give him before he shot her dead.

The South African Olympic sprinter read the poem to the court after five days of gruelling cross-examination.

Earlier, he said he was “heartbroken” when he saw her body in the early hours of Valentine’s Day last February.

Mr Pistorius denies murder, saying he fired through a door in fear, believing there was an intruder behind it.

It has been exhausting just to watch Oscar Pistorius – doubled up on the ropes for hour after hour, heavy arms trying to fend off another clinical combination of lethal jabs and low blows from prosecutor Gerrie Nel.

As the athlete finally slinks wearily back across the court from the witness stand to the dock, he must know that the last five days have done him few favours in this trial.

He has been forgetful, evasive, agitated, uncertain, argumentative, and defiantly – some would say deliberately – ambiguous about some of the key issues at the heart of this murder trial. However well his forensic experts proceed to shore up his testimony in the coming days, his credibility has been damaged.

I have been fending off emails from members of the public anxious to unearth some “smoking gun” detail that can resolve this case once and for all.

But the reality, from my vantage point in the public gallery here, is that there is no “smoking gun” – besides the obviously literal one.

The prosecution says he deliberately shot dead Ms Steenkamp, a 29-year-old model and law graduate, after the couple had had an argument.

He faces 25 years to life in prison if convicted of premeditated murder.

Mr Pistorius’ defence lawyer Barry Roux presented to the court the Valentine card which Ms Steenkamp had got the athlete.

The double-amputee sprinter, 27, read it out in a trembling voice.

The front of the card reads: “Roses are red, violets are blue…”

Inside, she had written: “I think today is a good day to tell you that, I love you.”

Ms Steenkamp was shot dead in the early hours of Valentine’s Day – before they had opened each other’s cards and gifts.

The athlete has previously told the court he only opened the card on Ms Steenkamp’s birthday, in August 2013.

Oscar Pistorius Trial : ` Prosecutor `Suggested South African Athlete is Using his Emotions ' as an Escape '

#AceWorldNews – PRETORIA – SOUTH AFRICA – April 14 – (BBC) – The prosecutor at the Oscar Pistorius murder trial has suggested the South African athlete is using his emotions “as an escape”.

He broke down in tears four times on Monday and has also vomited in court.

“Now you trying to be emotional and it’s not working,” said prosecutor Gerrie Nel.

Mr Pistorius admits killing girlfriend Reeva Steenkamp in February last year, but says he fired his gun after mistaking her for an intruder.

Mr Nel said the Olympic sprinter, 27, had deliberately shot Ms Steenkamp, a model, after the couple had had an argument.

As the prosecutor resumed his cross-examination on Monday, he accused Mr Pistorius of “tailoring his evidence” as he went along to suit the defence case, which had been “concocted”.

“Your version of events is untrue,” Mr Nel said.

The prosecutor said the fact that a pair of Ms Steenkamp’s jeans was lying on the floor showed that she was in the middle of getting dressed in order to leave Mr Pistorius’ house when she was shot after the couple had argued in the early hours of Valentine’s Day 2013.

This, too, was denied.

The sprinter also started sobbing as he recalled shouting at the burglars he thought were in his house.

When asked why he broke down, Mr Pistorius said: “I am traumatised” by the events of that night.

Prosecutor Gerrie Nel said it was “improbable” that she would stand in the bathroom saying nothing while Mr Pistorius was just 3m (10ft) away shouting at her to call the police.

Mr Pistorius said he could not explain why she had not shouted out.

The athlete, 27, denies murder saying the killing was a terrible accident.

He admits killing Ms Steenkamp but says he fired his gun after mistaking her for an intruder.

He believed she had been in bed when he grabbed his gun, made his way to the bathroom and fired shots through the door.

The prosecution says he deliberately killed her after an argument.

On the third day of his cross-examination, Mr Nel pressed the South African Olympic sprinter to explain the final moments leading up to the shooting.

He asked why he had not checked whether Ms Steenkamp had heard his calls for her to phone the police, or why he had not taken her to safety instead of going to confront the supposed intruder.

Mr Pistorius said it was his personality to confront what he believed was an intruder.

The trial has been adjourned until Monday morning.

#AceWorldNews – PRETORIA – SOUTH AFRICA – April 08 – (BN24) – Pretoria – Murder accused Oscar Pistorius was frantic to break down a toilet door to see if who he had shot was his girlfriend Reeva Steenkamp, the North Gauteng High Court in Pretoria heard on Tuesday.

“At that time all I wanted to do was just look inside to see if it was Reeva,” he said, crying.

Pistorius was recalling events of the early hours of Valentine’s Day last year when he shot Steenkamp through the locked toilet door of his Pretoria home.

He said after he shot four times at the door, he did not know what to do.

As Pistorius went over the events, he spoke using his hands.

The closer he got to telling the court how he found out it was Steenkamp in the toilet cubicle, the more emotional he became.

He said he looked for Steenkamp in the bedroom, but could not find her. He put on his prosthetic legs and ran to the bathroom, putting his firearm on the carpet.

He said he kicked the door, and then went to the bedroom to fetch his cricket bat. At the time, the lights were on in the bathroom.

“The lights were on at that stage. I remember it was when I kicked the door,” an emotional Pistorius said.

He said he hit the door three times then took a big plank and threw it at the door.

Then he saw Steenkamp.

“At that point, all I wanted to do was climb into the toilet,” he said.

“I unlocked the door… And I sat over Reeva and I cried. I don’t know how long I was there,” he said, breaking down.

His sister Aimee also burst into tears in court.

Judge Thokozile Masipa adjourned the court for the athlete to compose himself.

As court adjourned, Pistorius sat crying out loud. Aimee rushed to his side and hugged him, followed by his brother Carl and other relatives.

Pistorius is on trial for the murder of Steenkamp, who was shot through the locked toilet door of his Pretoria home on 14 February last year.

He says he mistook her for an intruder.

He has pleaded not guilty and in his plea statement denied he had argued with her shortly before the shooting.

He also faces two charges related to contravening the Firearms Control Act, to which he has denied guilt.

“I was simply trying to protect Reeva,” he told the court, his weeping voice quavering with emotion.

Pistorius, 27, faces a life sentence in prison if convicted for killing his girlfriend. He has pleaded not guilty to charges of murder and three firearms-related offences.

He said he is taking anti-depressants and sleeping pills.

Prosecutors say Pistorius killed Reeva following an argument, a charge that he denies.

Oscar Pistorius Trial: ` Prosecutors ask for Recess to Re-Examine Evidence to Date ‘

#AceWorldNews – Pretoria – South Africa – March 20 – The prosecutor in the Oscar Pistorius murder trial abruptly asked for a recess to “re-examine our case” today after presenting a grim bullet-by-bullet account of what happened when Pistorius fired through a bathroom door, killing his girlfriend Reeva Steenkamp.

The powerful testimony caused Pistorius to again stick his fingers in his ears as he frequently done during the trial.

The case had been expected to last six weeks and the prosecutor had present the court with a list of 107 potential witnesses. But today prosecutor Gerrie Nel told the High Court in Pretoria that he was about to wrap up his case asked for a recess that would last until Monday.

“We have reached a junction in the trial where the state is wrapping up its evidence,” Nel told the court. “We must look at what the defence version forces us to re-examine our case and our witnesses.”

Nel told the court that he plans to call only four to five more witnesses.

#AceWorldNews PRETORIA, South Africa – Months before he killed his girlfriend, Oscar Pistorius said he drew his gun and went into “combat mode” after thinking he heard the noise of an intruder at his home, which turned out to be a washing machine, a South African guns expert testified Monday at the athlete’s murder trial.

Sean Rens also said Pistorius wanted to buy seven more guns in 2012 – to add to the 9 mm pistol he already owned for self-defence – and asked the firearm trainer to procure them for him under a gun collector’s permit.

Darren Fresco was asked by Pistorius to take the blame, a previous witness testified, when a gun the Olympic runner was handling fired under a table in a restaurant in early 2013, about a month before Pistorius shot dead girlfriend Reeva Steenkamp.

#AceWorldNews says – Day Three – Pretoria as Oscar Pistorius’s murder trial was set Wednesday to hear further testimony of screams and gunshots the night Reeva Steenkamp died, challenging the sprinter’s defence against premeditated murder.

In vivid testimony that cast doubt on the Paralympian’s claims of a “tragic accident”, three state witnesses have told the court they heard a commotion then gunshots on Valentine’s Day 2013 at Pistorius’s home.

The trio’s account directly contradicts Pistorius’s claim that he shot his girlfriend, a 29-year-old model and law graduate, through a locked toilet door after mistaking her for an intruder.

“When I’m in the shower, I relive her shouts.
The terrifying screams,” university lecturer Michelle Burger said on Tuesday, her voice cracking with emotion as she was unable to hold back the tears.
Burger’s husband, Charl Johnson, also took the stand, telling judge Thokozile Masipa that a woman’s screams woke him up and that he ran to his balcony, less than 200 metres from Pistorius’s home.

Michell Burger, a woman who lives on an estate next to Pistorius’ gated community, said she and her husband were awoken by the screams in the pre-dawn hours of Feb. 14 last year, when Pistorius killed Reeva Steenkamp by shooting four times through a door in his bathroom.
