formal presentation of UN Secretary-General António Guterres‘s report took place on 14 October in New York. The report reveals multiple Russian crimes in Crimea, including a direct replacement of the population in the occupied region.

By resettling people from mainland Russia to Ukrainian Crimea in an attempt to alter the demographics of the area, Russia deliberately violates Geneva conventions.

It was the UN Assistant Secretary-General for Human Rights Andrew Gilmour who presented the report on how the Ukrainian 2018 resolution is being implemented. Answering a question by a Ukrainian representative in the course of the presentation, Mr. Gilmour emphasizedthat transferring populations into an occupied area violates the Geneva Conventions, in particular, the fourth Geneva Convention on the Protection of Civilian Persons in Time of War.

As the Russian delegate in his objection stated that the General Assembly’s Resolution on human rights in Crimea was “politicized, based on unverified and clearly falsified information,” Andrew Gilmour reminded that his office has not been unable to access Crimea despite the requests it made to Russia.

Two important aspects:

  1. For the first time in five years of the occupation, we have an analysis of the situation on the Crimean peninsula prepared by the UN Secretary-General… The most important things are named:– Russia is an occupying power, subject to obligations under international law.– Russia completely ignores these obligations.
  2.  Russia deliberately pursues policies aimed at changing the demographic situation in Crimea, which is a gross violation of international humanitarian law. On the one hand, the Russian authorities are taking measures to coerce those who disagree with the occupation to leave the peninsula, and on the other, in 2014-2018, it has transferred 140,000 of its citizens to the Ukrainian peninsula, including servicemen and their families … This, in particular, is made to secure the annexation attempt, to create additional obstacles for further de-occupation.

Changing demographics in the occupied territories violates the Fourth Geneva Convention. Russia implemented the same scenario in the occupied territories of Georgia.

It is important for Ukraine that the UN Secretary-General finally spoke out on this. All Russian crimes are recorded and will be used to hold Moscow accountable, including in subsequent resolutions and international courts.

At the outset, my delegation would like to extend its sincere appreciation to the UN Secretary-General for the release of 12 reports, and among them of the very first report “Situation of human rights in the Autonomous Republic of Crimea…” … I would also like to ask you, Mr. Gшlmour, while reporting to the UN GA to pay special attention to the main root causes of human rights violations and abuses in Crimea, namely the foreign aggression and temporary occupation of the peninsula by the Russian Federation. … I would appreciate your advice on the steps and actions to be taken by the UN in general and the General Assembly, in particular, to stop transferring of the Russian population to Crimea and prevent consequences of such actions of the occupying power.

Population replacement in occupied Crimea

The report of the Secretary-General states, in particular, that international humanitarian law prohibits individual or mass forcible transfers, as well as deportations of protected persons from occupied territory regardless of the motive of such actions. The OHCHR (Office of the UN High Commissioner for Human Rights) notes that, according to the court registry of the Russian Federation, during 2017–2018 courts in Crimea ordered the transfer of at least 947 individuals considered foreigners under the laws of the Russian Federation, including the transfer of 518 Ukrainian citizens who lived in Crimea.

What is yet more important, under international humanitarian law, the occupying power must not transfer parts of its civilian population into the territory it occupies. As reported by OHCHR, during 2014–2018, 140,198 people changed their residency registration from regions of the Russian Federation to what Russia calls “the Republic of Crimea.” These relocations include appointments of public sector employees from the Russian Federation to Crimea, transferring servicemen with their families to the peninsula in the Russian framework of the militarization of the peninsula.

Particularly, at least 19,000 Russians resettled to the peninsula while 17,500 locals departed in 2018. Some 17,000 Russians moved in and 16,000 Crimean residents moved out from the occupied region in 2017.

The UN Sec-Gen’s report, not only provides data and evidence of population replacement in Crimea but also confirms all other Russian crimes and violations mentioned in the previous UN General Assembly Resolutions. The most important cases are:

  • Violating the A/RES/73/263 resolution, Russia denied the OHCHR access to the peninsula. Therefore, the Office was obliged to conduct remote monitoring based on the information from the human rights monitoring mission in Ukraine as well as Crimean civil activists and witnesses who fled occupied Crimea to mainland Ukraine.
  • Russia, the occupying power, automatically extended the Russian Federation’s citizenship to all Ukrainian citizens who resided in Crimea on a permanent basis. This is a violation of the right to a nationality. People who rejected Russian citizenship were considered as foreigners and faced deportation.
  • Russian Federation laws against terrorism, extremism, and separatism, designed to persecute political opponents, were applied to acts committed before the occupation, against all commonly accepted judicial norms.
  • The same laws were used for arbitrary arrests, usually preceded by house raids and searches conducted by the police and the FSB special service. From 1 January 2017 to 30 June 2019, OHCHR recorded 186 searches. In some cases, individuals were reportedly detained even without formal charges.
  • OHCHR received information alleging torture and ill-treatment of individuals deprived of their liberty, usually on the basis of the same above-mentioned laws against terrorism, extremism, and separatism. Torture was used to obtain forced confessions from the victims. Perpetrators resorted to various forms of torture, including mock executions, beatings, and electric shocks, as well as sexual violence.
  • Prisoners had not received adequate medical assistance
  • Religious organizations had to re-register according to Russian procedures. Some communities, including the Ukrainian Orthodox Church, chose not to re-register and now the Russian occupation authorities of Crimea consider that such organizations have lost their legal status. This led to the non-recognition of church property. Other religious communities with strong links to churches in other parts of Ukraine, like the Ukrainian Greek Catholic Church, were denied registration in the peninsula.
  • To avoid repercussions for independent journalistic work, journalists frequently self-censored, used pseudonyms and filtered their content before publication.
  • Authorities didn’t allow protests or rallies that were critical to Russian policies. In particular, courts arrested or fined 80 Muslim men who conducted single-person protests in October 2017 against criminal cases against other Muslims perceived as sympathizers of unauthorized religious groups.
  • Further concerns emerged about the legitimate exercise of the right to freedom of expression in Crimea following the introduction by the Russian Federation on 18 March 2019 of new laws on the offenses of “public insults towards State authorities” and “distribution of false information of public importance.”
  • OHCHR has documented a narrowing of space for manifestations of Ukrainian and Crimean Tatar identities and enjoyment of the respective cultures in Crimea. Crimean authorities exerted pressure on members of Ukrainian cultural organizations and imposed a total ban on the Mejlis, an important self-governing institution of the Crimean Tatar people. Members of the civic group “Ukrainian Cultural Centre” were threatened and interrogated by the sham authorities of Crimea on dubious grounds.
  • The number of school students instructed in the Russian language increased to 96.7% of all students, from 90.7% in 2013–2014, and the number of students instructed in Ukrainian decreased to only 249 children from 12,694 in 2013-2014. OHCHR documented cases in which the school administration disregarded or rejected explicit requests from parents to use Ukrainian or Crimean Tatar as the language of instruction for their children.
  • International humanitarian law forbids the occupying power to compel people on the occupied territory to serve in its armed or auxiliary forces. As of 2019, the total number of Crimean men conscripted into the Armed Forces of the Russian Federation since 2015 amounted to at least 18,000. There had been least 29 guilty verdicts in criminal prosecutions of Crimean men for draft evasion since 2017.

Authorized the Russian Foreign Ministry on issues of human rights, democracy and the rule of law prepared by the “White Book” (in Russian and English), which summarizes the numerous violations of human rights and the rule of law in Ukraine since the end of November 2013 to the end of March 2014 year.

It is based on information materials Russian, Ukrainian and some Western media, saying leaders of the “new government” of Ukraine and their supporters, eyewitness accounts, as well as observations and interviews from the event, collected Russian NGOs.

The report’s factual information, flagrant violations of fundamental international principles and norms of human rights and the rule of law committed to monopolize the protest “evromaydan” radical nationalists condoned and sometimes in direct promotion supported their U.S. and EU suggest that these phenomena widespread.

As a result of the violent seizure of power and unconstitutional coup in Ukraine took the actual collapse of the legitimate government, legal arbitrariness reigned. Commonplace there were the growth of ultra-extremist and neo-Nazi sentiments, religious intolerance and xenophobia, threats and pressure from the leaders of the “evromaydana” on his political opponents, lustration, repression and physical violence, banditry frank.

The main objective of the “White Paper” – sharpen on these facts the attention of the international community and key international bodies in the field of human rights, as well as relevant non-governmental organizations which have not shown proper and impartial attention to the issue of identifying and bringing to justice those responsible for these violations.

#AceNewsServices – MOSCOW – April 23 ( INTERFAX.RU ) – The State Duma on Wednesday passed in the second and third readings in the law on criminal responsibility for public rehabilitation of Nazism, setting a fine for it to 500 thousand rubles or imprisonment for up to five years.

Appropriate amendments are made to the Criminal Code and the Code. The Criminal Code is complemented by Article “Rehabilitation of Nazism.”

It reads: “The denial of the facts established by the verdict of the International Military Tribunal for the trial and punishment of the major war criminals of the European Axis countries, the approval of the offences established by the said judgement, as well as dissemination of false information on the activities of the Soviet Union during World War II, coupled with the accusation of committing offences established by the said judgement, committed publicly, punishable by a fine of up to 300 thousand rubles, or imprisonment for up to three years. ”

Tougher sanctions proposed to install for the same acts committed by a person using his official position or media, “as well as fabrication of prosecution evidence.” For this set a fine of 100 thousand to 500 thousand rubles; as an alternative – imprisonment for up to five years with deprivation of the right to occupy certain positions or engage in certain activities for a term up to three years.

Also makes it an offence to five years imprisonment for defiling days of glory and anniversaries Russia associated with the Great Patriotic War.

Corresponding norm provides for sanctions for “spreading expressing clear disrespect for society information about the days of glory and anniversaries Russia related to the protection of the Fatherland, as well as the desecration of symbols of military glory of Russia, committed in public.” For it shall be fined up to 300 thousand rubles; as an alternative – compulsory work for a period of up to 360 hours, or correctional labour up to one year.

RF Code of Administrative Offences with the norm, introducing penalties for “public dissemination of expressing clear disrespect for society information about the days of glory and anniversaries Russia related to the protection of the Fatherland, or the public desecration of the symbols of military glory of Russia, including those committed with the use of media and information and telecommunications networks, including the Internet. ”

These offences entail the imposition of an administrative fine on legal entities in the amount of 400 thousand to 1 million rubles.

The investigation of these crimes will be within the competence of the Investigative Committee of the Russian Federation.

The law was passed by the State Duma in the first reading on April 4. He was supported by all factions of Parliament.

The draft law on the responsibility for rehabilitation of Nazism was initiated by a group of deputies headed by Irina Spring.

Deadly gun battles have broken out in the eastern Ukrainian city of Slavyansk as separatists seize government buildings in at least one other city in the region. Ukraine’s Interior Minister Arsen Avakov said one officer was killed and another five injured as security forces attempted to retake occupied security buildings. In a statement on his Facebook page Mr Avakov said there was also an “unidentifiable number” of casualties among the protesters, who are being supported by around 1,000 civilians. Russia’s RIA news agency confirmed at least one activist had been killed in the raid.

Separatists are currently guarding barricades outside the occupied buildings and have set up checkpoints on roads leading into the Slavyansk. Ukraine’s acting President Oleksandr Turchynov has mobilised the army and said a “full-scale anti-terrorist operation” was being launched. He offered an amnesty to protesters who surrendered their weapons by Monday morning. He accused Russia of being behind the unrest to justify expanding its military control beyond Crimea, but this is rejected by the Kremlin.

The US has threatened to bolster existing sanctions against Moscow if the trouble continues. It also blames the country for inflaming tensions in eastern Ukraine. “I think we’ve seen that the sanctions can bite,” said Samantha Power, America’s ambassador to the UN. “If actions like the kind we’ve seen over the last few days continue, you’re going to see a ramping up of those sanctions.”

Media, who are based in Slavyansk, said the centre remains relatively calm and reports of fatalities were thought to be linked to clashes well into the outskirts. It’s reported that civilians, some of them elderly, have been stood at one checkpoint since late last night to act as “human shields” to protect pro-Russian protesters from Ukrainian security forces. Elsewhere local media is reporting that protesters have seized the mayor’s office in the eastern city of Mariupol. One report said activists entered the building unhindered after around 1,000 people took part in an independence rally. It said barricades were erected around the office and the Ukrainian flag removed. If confirmed that would bring the total number of cities where administrative buildings are under the control of separatists to five.

Masked men, wearing unmarked camouflage uniforms and carrying special-issue assault rifles, seized the local police headquarters in Slavyansk on Saturday. They later took control of the security service building in the city, which lies some 90 miles from the Russian border. Also on Saturday gunmen seized a police station in the eastern city of Kramatorsk following a shoot-out. Other groups began their occupation of security buildings in Donetsk and Luhansk last weekend. Protesters in the region, which has a large ethnic Russian population, hope to follow in the footsteps of the Crimean Peninsula and force a referendum on joining the Russian Federation.

The area was a strong bastion of support for ousted President and Kremlin ally Viktor Yanukovych and many residents fear they will be suppressed under the new Western-friendly interim government in Kiev. Moscow has also warned any Ukrainian military aggression against ethnic Russians will derail top-level talks on the crisis scheduled to take place in Geneva next week. Western leaders have expressed concern that the latest unrest strongly echoes the events which led to Russia’s annexation of Crimea last month following an overwhelmingly-backed referendum. The United States has pledged its “strong support” for Ukraine’s new government and urged Russia to de-escalate tensions. It has also called on Moscow to withdraw its troops from Ukraine’s eastern border, where Nato claims up 40,000 soldiers are now stationed. The EU and US have imposed a number of sanctions on Russian and Ukrainian individuals, but are yet to directly target Russia’s economy

#AceBreakingNews – UKRAINE- April 13 – (Reuters) – Ukraine’s armed forces plan to launch a “full-scale anti-terrorist operation” against pro-Russian separatists, acting president Oleksander Turchinov said on Sunday, raising the risk of a military confrontation with Moscow.

Angered by the death of a state security officer and the wounding of two of his comrades near the flashpoint eastern city of Slaviansk, Turchinov gave rebels occupying state buildings until Monday morning to lay down their weapons.

He blamed Russia, which opposed a pro-Europe uprising that forced Moscow-backed former president Viktor Yanukovich to flee, for being behind the rash of rebellions across Russian-speaking towns in eastern Ukraine.

“The blood of Ukrainian heroes has been shed in a war which the Russian Federation is waging against Ukraine,” he said in an address to the nation. “The aggressor has not stopped and is continuing to sow disorder in the east of the country.”

The press service of the State Border Service of the Ukraine on Friday pursuant to the Instructions of the Cabinet of Ministries that Russian citizens will be subject to additional requirements.

Now Russian citizens who legally arrived in the Ukraine, may temporarily stay in its territory not more than 90 days within 180 from the date of first entry, unless another term is not defined by international Treaties of the Ukraine, said the State Border Service.

This decision will not apply to the citizens of Russia crossing the Russian-Border.

#AceWorldNews – SIMFEROPOL April 02 – All websites connected with Ukraine’s far-right movement Right Sector are blocked in Russia, head of Russian telecommunications watchdog Alexander Zharov said at a meeting with Prime Minister of the Russian Republic of Crimea Sergey Aksyonov in the Crimean capital city on Wednesday.

“We have blocked completely the spread (of Right Sector websites) on the territory of the Russian Federation in all networks, including Facebook and Twitter. This work is essential important, we intend to continue it,” Zharov noted.

Russian telecommunications watchdog would spread its activity on the Russian Republic of Crimea in the near future, Zharov noted. Notably, he talked about such spheres of work as fight against pirate content. Zharov added that the watchdog that he heads had already received 30 decrees from the Prosecutor

General’s Office to block extremism-related websites before court proceedings. The access was blocked to 146 Internet resources.

Zharov also noted that the watchdog had already received around 80,000 petitions from people who complained of undesirable content, including child’s pornography in the Internet. The access was blocked to 23,500 Internet resources.

This was after following an attempt by ultra nationalists to force their way into an office of the Russian Federal Agency for CIS Affairs, Compatriots Abroad and International Humanitarian Cooperation in the Ukrainian capital.

“On March 23, a group of persons who claimed to be the ‘11th Maidan hundred’ attempted to enter the building in Kiev rented by the Russian Federation for the work of the Russian Centre of Science and Culture in the capital of Ukraine.

These persons stated their wish to use the premises, the property and equipment belonging to the Russian Federation for setting up their headquarters there.

They threatened the Ukrainian citizens who were present there and warned them against cooperation with Russia.

They also stole the Centre’s car,” the ministry said.

#AceWorldNews – The United States military are planning large scale war games in Poland, which would involve troops from several eastern European states, the American ambassador to the country, Stephen Mull, said.

Poland, the Czech Republic, Hungary, Slovakia, Bulgaria, Romania and the Baltic states (Lithuania, Latvia and Estonia) will be participating in drills, together with the Americans, Mull told Radio ZET.

Lask airbase in central Poland has been selected as the venue for the military exercise, the ambassador said, refraining from saying when it was scheduled for.

Mull’s announcement comes just three days after US Vice President Joe Biden’s visit to the Polish capital of Warsaw.

Biden’s trip was aimed at reassuring that America remains a “steadfast ally” to Poland and the Baltic States after they expressed anxiety over the events in the Crimea, which signed a treaty of accession to the Russian Federation on Tuesday.

The investigation believes that in his speeches, the leader of Ukrainian ultranationalist organization Right Sector Dmytro Yarosh publicly called anti-Russian forces to extremist actions ant terrorism on Russia’s territory.

The solemn ceremony of signing took place in the Ekaterininsky reception hall of the Grand Kremlin Palace.

Putin has put his signature below the bill on ratification of the interstate treaty “On the admission of the Republic of Crimea into the Russian Federation and creation of new sub-federal entities” signed by the parties March 18.

From this date, the Republic of Crimea is considered part of the Russian Federation.

#AceBreakingNews says a referendum on the status of Crimea will be held March 16, the region’s deputy prime minister announced. Crimeans will be asked to decide if the autonomous republic stays part of Ukraine or joins Russia.

“The referendum will take place March 16,” said the autonomous region’s First Deputy-Premier Rustam Temirgaliev, according to ITAR-TASS.

The new date is two weeks earlier than the one announced last week.

There will be two questions on the ballots.

  1. Are you in favour of Crimea becoming a constituent territory of the Russian Federation ?
  2. Are you in favour of restoring Crimea’s 1992 constitution ? Temirgaliev said.

  3. According to the 1992 constitution, the autonomous republic is part of Ukraine but has relations with Kiev, defined on the basis of mutual agreements.

    Sevastopol residents will take part in the referendum, despite the city enjoying a special status and not officially being a part of Crimea, according to Sergey Shuvainikov, a Crimean MP.

    “We will give Sevastopol an opportunity to have its say,” he said, as cited by RIA Novosti.

    Meanwhile the Crimean MPs have unanimously voted for the region to become a part of Russia.
