(FLORIDA) Justice Dept Court Report: Peruvian National Sentenced to 90 Months in Prison for Conspiring to Defraud Thousands of Spanish-Speaking Immigrants #AceNewsDesk report

#AceDailyNews DOJ Press Release reports that two Co-Conspirators Plead Guilty and Another Two are Extradited to the United States to Face Charges with a Peruvian national who has been sentenced to 90 months in prison for operating a series of call centers in Peru that defrauded Spanish-speaking U.S. residents by falsely threatening them with arrest, deportation and other legal consequences.

According to court documents, Omar Cuzcano Marroquin, 32, of Lima, Peru, was sentenced for conspiring to commit mail fraud and wire fraud through a series of Peruvian call centers that used false statements and threats to obtain money from Spanish-speaking individuals across the United States. Cuzcano and others falsely told victims that they were required to accept and pay for English-language courses and other educational products and that failure to do so placed them in legal jeopardy.

Cuzcano admitted that he and his employees falsely claimed to be lawyers, court officials, federal agents and representatives of a so-called “minor crimes court,” which does not exist. The callers falsely threatened victims with court proceedings, negative marks on their credit reports, imprisonment and immigration consequences if they did not immediately pay for the purportedly delivered products and settlement fees. Between April 2011 and July 2019, thousands of U.S. victims made payments based on calls from their call centers. Cuzcano and his co-conspirators collected millions of dollars from victims.

“The Department of Justice’s Consumer Protection Branch will steadfastly pursue and prosecute transnational criminals who defraud vulnerable U.S. consumers,” said Acting Assistant Attorney General Brian M. Boynton of the Justice Department’s Civil Division. “The defendants in this case brazenly defrauded recent immigrants by falsely promising free products to improve their English. In reality, the defendants were luring their victims into a trap of intimidation and fear, leaving them far worse off – with substantial financial losses and, often, emotional scars from these crimes. Today’s sentence demonstrates that defendants who prey upon U.S. consumers from abroad will not do so with impunity.”

“Today’s sentence serves not only as just punishment for this defendant but also as notice to others who seek to prey on vulnerable victims in the United States,” said Acting U.S. Attorney Juan Antonio Gonzalez for the Southern District of Florida. “Know that the Justice Department and its partners will aggressively investigate such criminal activity. Wherever you are, we will find you and hold you accountable.”

“In this international telemarketing scheme, deceptive scare tactics were used to threaten thousands of vulnerable U.S. consumers into purchasing undelivered products by falsely purporting to use America’s legal system against them and coercing them out of millions of dollars,” said Inspector in Charge Joseph Cronin of the U.S. Postal Inspection Service, Miami Division. “Today’s sentencing hopefully brings relief to U.S. residents who were victimized by this transnational fraudulent scheme. The U.S. Postal Inspection Service, along with the Department of Justice’s Consumer Protection branch and the U.S. Attorney’s Office, are committed to holding individuals who use the U.S. Mail to defraud consumers accountable.”

Two of Cuzcano’s co-defendants also recently pleaded guilty for their roles in the scheme. Henrry Adrian Milla Campuzano, 37, of Lima, Peru, pleaded guilty to conspiracy to commit mail and wire fraud earlier today. According to court documents, Milla was the owner and operator of fraudulent call centers located in Peru called “Latinos en Accion” and “Accion Latino,” which similarly extorted immigrants in the U.S. by falsely identifying themselves as private company lawyers and court or immigrations officials.

Another co-defendant, Fernan Huerta Haro, 34, of Lima, Peru, pleaded guilty to conspiracy to commit mail and wire fraud on June 11. According to court documents, Huerta owned and operated call centers called “Camino Al Progreso” and “Neshuer Corporation” in Peru. In pleading guilty, Huerta admitted that, from 2011 until his 2019 arrest, he and his employees threatened and defrauded many Spanish-speaking recent immigrants to the United States as part of the scheme. 

Milla and Huerta will be sentenced by U.S. District Judge Robert N. Scola Jr. this fall, and both face a maximum penalty of 20 years in prison. Judge Scola will determine their sentences after considering the U.S. Sentencing Guidelines and other statutory factors.

Cuzcano, Milla and Huerta were part of a group of five defendants who were arrested on July 2, 2019, by Peruvian authorities based on a U.S. extradition request, and each has remained incarcerated since that time. The defendants were extradited to the Southern District of Florida on Oct. 23, 2020. All five defendants have now been convicted of conspiring to commit mail and wire fraud. Two additional indicted co-defendants in the case – Carlos Alberto Espinoza Huerta and Josmell Arturo Espinoza Huerta – evaded arrest at the time of their five co-defendants’ arrests in Peru. They were eventually located and arrested by Peruvian law enforcement, were extradited to the United States on June 25 and are being detained at the Federal Detention Center in Miami. 

The U.S. Postal Inspection Service and the Civil Division’s Consumer Protection Branch investigated the case. Trial Attorneys Phil Toomajian and Max Goldman of the Consumer Protection Branch are prosecuting the case. The Federal Trade Commission, the Justice Department’s Office of International Affairs, the U.S. Attorney’s Office for the Southern District of Florida, the State Department’s Diplomatic Security Service and the Peruvian National Police provided critical assistance.

Nearly 5,000 men died during the fierce storm which struck the Spanish fleet off Cape Finisterre, and 38 ships were lost.

Excited by the possibility that this could be a major wreck site, the Xunta de Galicia sent a team to the site the following day, but were only able to locate two of the three guns in spite of a concerted search. Suspicion was immediately aroused that the third cannon had been stolen, a hypòthesis which was confirmed when video footage emerged showing one of the cannons being lifted by a rope whilst it was being stolen.

Police rapidly identified those who had taken part in the alleged theft and during the course of the investigation, one of the  suspects handed the cannon over to the investigating officers.

The cannon was subsequently moved to the Museo del Mar in Vigo (Pontevedra) for assessment and conservation.

Work will now begin to stabilise the metal to prevent deterioration and experts will also work to learn more about the history of the three cannon and try to identify the vessel from which they came.

It’s unusual for artefacts of this nature to be lying on the seabed without forming part of a wrecksite, for which reason it is completely illegal to remove any archaeological artefact from the seabed.

Divers or fishermen locating any historical artefact should photograph their find and take GPS co-ordinates, before reporting the find to the Guardia Civíl.

This is because the removal of artefacts can compromise the evidence about a wreck and destroy valuable archaeological information, as well as encouraging the illegal re-sale of historical artefacts recovered from the sea. It can also be extremely dangerous; many remnants of armed conflicts lie off the Spanish coastline and unexploded bombs, mines and artillery shells are still found frequently by leisure divers; on occasions, by now defunct leisure divers who ignored the instructions not to touch anything found on the seabed.

‘ British Police Arrest Two Men Over Islamist State Links ‘

#AceBreakingNews – BRITAIN – September 26 – British police arrested on Friday two men as part of an operation into Islamist-related militancy, Reuters said.

The two men were arrested on the M6 motorway in England by counter-terrorism officers, bringing the total number of people detained in the operation to 11 over two days.

Spain’s Interior Ministry said on Friday that Spanish and Moroccan police have arrested nine people suspected of belonging to a militant cell linked to the Islamic State (IS) group.

In Malaysia, police have detained three Muslim men suspected of wanting to go to Syria to join the IS.

` Two Americans Injured in an Attack on US Consulate Vehicle in Herat ‘

#AceWorldNews – AFGHANISTAN – May 28 – Two Americans have been injured in an attack on a US consulate vehicle in western Herat province in Afghanistan, the US embassy said on Wednesday.

Both were receiving treatment at a Spanish hospital in the province, Reuters reported. “The US government is working closely with Afghan authorities to investigate the incident and bring the perpetrators to justice,” the statement said.

The attack comes a day after President Barack Obama announced that he plans for almost 10,000 American troops to remain in the country in 2015 if the Afghan government signs a security agreement.
Washington and its NATO allies will formally halt combat operations in Afghanistan at the end of this year.

The official was speaking in Barcelona at a demonstration of the ruling party on Sunday.

Saenz noted though that the government is ready for dialogue with Catalonia on various issues, as long as it is in line with the constitution.

She reiterated that if Catalonia quits Spain, it will also stop being a member of the EU, may have to quit the eurozone as well as the Schengen area.

According to (FoxNews) Hundreds of protesters have marched in Spain’s capital to call for the abdication of King Juan Carlos, the abolition of the monarchy and the establishment of a republic.

A large police presence blocked access to the Royal Palace, where the demonstration was due to end in a rally, with metal barriers and police vans.

Protesters marched under banners reading “Checkmate to the King” and chanting “Tomorrow, Spain will be a Republic.”

Madrid (CNN) — Clean-up was under way Sunday on damage to bus stops and outdoor cafes in central Madrid, after austerity protests turned violent Saturday night in the Spanish capital and left 101 people injured. There were 24 arrests.

The injured included 67 national and municipal police officers and 34 demonstrators. Eleven were taken to hospitals, including a national police officer who was kicked in the head, lost his riot helmet and lost consciousness, spokesmen for the central and Madrid city governments said.

Police say the protesters failed to inform the authorities of their itinerary, thus making the demonstration illegal.

#AceWorldNews – SPAIN – March 25 – Spain’s Constitutional Court ruled Tuesday that a referendum in Catalonia on independence from the rest of the country would violate the supreme law.

Judges said that a region within Spain “cannot unilaterally call a referendum on self-determination.” A poll published last week by the Centre for Opinion Studies found that up the 60 percent of Catalonians’ support independence.

The Spanish authorities have said they will discuss whether to allow Catalonia to hold a referendum or not in a parliamentary debate scheduled for April 8.

#Morocco : ” Seven Dead and One Thousand Rescued in Attempts to Swim to Europe by Migrant’s trying to reach Ceuta”

#AceWorldNews says seven people have drowned as part of a collective of 200 migrants trying to swim from Morocco’s mainland to Ceuta, a Spanish enclave attached to Morocco’s northern coast, according to the Spanish daily, El Pais.

Potential migrants make frequent attempts to cross the border separating the two, often risking their lives to access the territory which lies just 15 km over the sea from Spain.

Meanwhile, over 1,000 people were rescued from rafts near the Italian island of Lampedusa by Italy’s navy. The country is another major migrant point of entry into Europe and over 200 died in October last year alone, only a kilometre from the coast.

Sea crossings tripled last year, thought to be prompted by regional instability, including civil war in Syria.

#France : “Raises `Maritime Pollution Alert’ after `Spanish Cargo Ship’ splits in half near Bayonne”
